Motor Vehicle Accidents
Many people are injured as results
of motor vehicle
collisions on Missouri
and Illinois highways. If you
have sustained an injury from the negligence
of an operator of a motor vehicle whether
an automobile, truck, motorcycle or
motor boat, seek the advice
of an attorney immediately.
The insurance company
for the negligent party may attempt
to razzle dazzle and sweet talk you
into working with them but you are
playing into their hands.
Insurance
companies are profit motivated companies.
Their best interests are obviously not your
best interests.
Common
fact patterns in automobile accidents
or any other motor vehicle collision
cases are as follows:
- Violating the traffic signal.
- Excessive speed
- Failure to take evasive action
or warning
- Failure to keep a careful lookout
- Failing to signal an intention
to turn
- Failing to sound a horn before
starting to pass
- Failing to yield the right
of way
- Following too closely
- Passing on the right
- Suddenly slowly on the highway
without first giving adequate
and timely warning with intention
to slow
- Suddenly stopping on the
highway without first giving
an adequate and timely warning
of an intention to stop
|
- Driving on the wrong side of
the road
- Coming to collision with the
rear of another vehicle
- Violation of municipal codes
and state statutes
- Approaching an intersection
and failing to drive on your
side
- Driving in excess of the speed
limit
- Driving at a speed which makes
it impossible to stop within
the range of visibility
- Stopping in a lane reserved
for moving traffic
|
Unfortunately alcohol and controlled
substances play in a role in many motor
vehicle accident cases. Evidence of
such may entitle the injured party
in bringing a claim for punitive
damages.
 |
Other
causes of accidents are:
- Driver fatigue
- Use of electronic devices:
PDA’s, cell phones, etc.
- Road rage and/or aggressive
driving
- Indifference
- Recklessness
- Simple inattention

Seek Immediate Medical Attention
As of with any personal injury case
seek immediate medical attention if
you are injured. Do
not suffer in silence. Seek the advice of an attorney
immediately because of limitations
on the time periods on which you can
bring a lawsuit.
- Preserve your evidence if possible
- File
a police report
- Obtain the names
and address of any witnesses
- Write
down the details of the events surrounding
the accident
- Take photographs of
the scene, the damaged vehicles or
of anything else that may be important
to your case
- Use your cell phone
camera if you do not have your digital
camera with you
